Samsung and Ericsson Ink Licensing Deal, Ending Patent War

Late last year we heard Ericsson was suing Samsung after accusing it of taking liberties when it comes to the licensing of FRAND patents. The Fair, Reasonable And Non-Discriminatory system is applied to standard-essential patents to stop patent holders from holding the entire industry to ransom. It would effectively be impossible to develop workable standards without it.

In an ideal world FRAND wouldn’t be needed and companies would just play nice with their contributions on the understanding that a rising tide lifts all ships. But organizations of all types are overwhelmingly incentivised towards short term gain and it’s inevitable that opportunists within them will spot the opportunity for quick wins in things like patent negotiations.

We don’t know what Samsung was up to, or even if it was going against the spirit of FRAND at all, but lawyers largely exist for when people are unable to settle disagreements amicably. So after five months of presumably extensive legal fees paid by both parties, they have arrived at the point they could have reached last year at no expense: a cross-license agreement.

Not only is the agreement boringly mutual and balanced, the two companies are spoiling everyone else’s fun by keeping the details confidential. So we don’t even get to work out who won and who lost – a vital calculation at a time when nobody has time for nuance or complexity. The only clue offered is Q2 licensing revenues forecast to be SEK 2-2.5 billion, which is roughly what they should have been in Q1 if Samsung had coughed up. This implies a score draw.

Шведский производитель коммуникационного оборудования Ericsson и Samsung подписали долгосрочное соглашение о глобальном перекрёстном лицензировании, охватывающем патентный портфель всех технологий сотовой связи. Действие документа распространяется на продажи оборудования сетевой инфраструктуры и мобильных устройств, начиная с 1 января 2021 года.

Кроме того, стороны договорились «о проектах технологического сотрудничества для продвижения мобильной индустрии в области открытой стандартизации и создания ценных решений для потребителей и предприятий».

Это урегулирование положило конец спорам, в которые были вовлечены оба брэнда, завалившие взаимными претензиями Комиссию по международной торговле США (USITC), а также суды нескольких стран. Инициатором патентной войны выступили шведы, решившие, что корейцы "покусились на святое". Однако многомесячное судебное разбирательство не выявило каких-либо преимуществ патентного портфеля Ericsson над технологическими достижениями южнокорейского чеболя. По итогам слушаний была подтверждена ценность сильных патентных портфелей обоих фигурантов. Профильные СМИ сообщают, что ввязавшись в разборки с Samsung, шведы лишь потеряли время и деньги, выплаченные дорогим юристам. Анализ доходов Ericsson за последние пару кварталов показал, что никаких дополнительных отчислений за лицензирование получено не было, то есть Samsung не выплачивал никаких компенсаций, на которые рассчитывали "потерпевшие". Детали соглашения конфиденциальны и разглашению не подлежат.

Однако нет худа без добра: в обозримой перспективе Samsung и Ericsson не будут беспокоить друг друга по разным пустякам.

Insiders are no longer talking about the possible transition of Samsung smartwatches to Wear OS

 

More than two months ago, numerous media outlets spread the "good news" around the world from a "reliable source" in the person of an anonymous Chinese informant Ice Universe that in future Galaxy Watch models it is planned to replace Samsung's own operating system (TIZEN) to Google's licensed Wear OS. At that time, many IT experts expressed bewilderment and even outrage at this fact, since TIZEN far exceeds the capabilities of Wear OS. In addition, one of the main advantages of TIZEN is that this platform is practically completely controlled by the South Korean tech giant and is being developed in close cooperation with manufacturers of hardware solutions. Thus, the best optimization of the hardware and software parts of the Samsung smartwatch is achieved.

The transition from TIZEN to Wear OS looks like an unjustified concession to the exorbitant ambitions of Google, which seeks to cover the vast majority of mobile devices manufactured in the world with its software solutions. Such monopolization greatly harms end consumers, since it reduces the choice to a minimum and does not allow the implementation of interesting projects based on other software platforms.

However, to date, no South Korean media has confirmed rumors of a possible Samsung policy change for its wearable devices. Moreover, in the new leaks, the whistleblowers say nothing more about the presence of Wear OS in the future models of the Galaxy Watch and Galaxy Watch Active series.

Samsung has yet to comment on plans for its future wearable devices.

Более двух месяцев назад многочисленные СМИ разнесли по миру "благую весть" от "надёжного источника" в лице анонимного китайского информатора Ice Universe, что в будущих моделях Galaxy Watch якобы планируется замена собственной операционной системы Samsung (TIZEN) на лицензионную Wear OS от Google. Тогда многие IT-эксперты выразили недоумение и даже возмущение этим фактом, поскольку TIZEN намного превосходит возможности Wear OS. К тому же одним из главных преимуществ TIZEN является то, что эта платформа фактически полностью контролируется южнокорейским техногигантом и разрабатывается в тесном сотрудничестве с производителями аппаратных решений. Таким образом, достигается наилучшая оптимизация аппаратной и программной частей смарт-часов Samsung.

Переход с TIZEN на Wear OS выглядит как неоправданная уступка непомерным амбициям Google, стремящегося охватить своими софтверными решениями подавляющее большинство мобильных устройств, выпускаемых в мире. Такая монополизация сильно вредит конечным потребителям, поскольку снижает возможность выбора до минимума и не позволяет реализовывать интересные проекты, основанные на других программных платформах.

Однако на сегодняшний день ни одно южнокорейское СМИ не подтвердило слухи о возможной смене политики Samsung для своих носимых устройств. Более того, в новых утечках информаторы больше ничего не говорят о наличии Wear OS в будущих моделях серии Galaxy Watch и Galaxy Watch Active.

В Samsung до сих пор никак не прокомментировали планы в отношении своих будущих носимых устройств.
