Южнокорейский производитель часов Orient Bio Inc. пытается запретитить продажи Samsung Galaxy Watch из-за их названия

Южнокорейский производитель механических часов Orient Bio Ink. (именно южнокорейский, а не японский Orient, как ошибочно указано во многих СМИ) в минувший вторник заявил, что подал в суд прошение о запрете продаж смарт-часов Samsung Galaxy Watch, поскольку марку Galaxy для своих продуктов он зарегистрировал ещё в прошлом веке, а именно в 1984-м году. Orient производит различные часы под этим брэндом до сих пор и утверждает, что использование корпорацией Samsung Electronics названия Galaxy может причинить ущерб "оригиналу".
В августе Samsung провёл ребрендинг своих смарт-часов серии Gear S, назвав новую модель Galaxy Watch, чтобы продвигать все свои смарт-устройства под единой торговой маркой. Однако менеджмент ведущего корейского чеболя вряд ли подозревал, что это может вызвать такую реакцию со стороны часовщиков.
Юридическая коллизия заключается в том, что продукты Orient при регистрации марки Galaxy были отнесены в категорию "ювелирные изделия", в то время как продукты Samsung зарегистрированы в категории "электронные устройства".
Orient настаивает на том, что в случае, если они решат производить смарт-часы, принадлежащая им торговая марка Galaxy окажется занятой конкурентами.
Представители электронного гиганта заявили, что Samsung объявит о своей позиции по указанному вопросу после подробного рассмотрения дела, сообщает информационное агентство Yonhap News.

Orient files injunction for sales ban on Samsung smartwatches

South Korean watch maker Orient on Tuesday said it filed a court injunction to ban Samsung Electronics Co. from selling its Galaxy smartwatches, accusing the tech giant of brand infringement.
The watch maker registered the Galaxy brand for its products in 1984 and has been producing timepieces under the name since then.
In August, Samsung re-branded its smartwatch to Galaxy from the previous name, Gear, reflecting its efforts to expand the products' connectivity with Galaxy smartphones.
Orient said the use of the name "Galaxy" on smartwatches is a clear violation of fair trade and patent laws.
The watch maker said Samsung's use of the name will hinder the company from developing its own smartwatches.
Samsung Electronics' Galaxy smartwatches are currently classified as electronic devices under the local patent system, and Orient's products are considered jewelry.
The South Korean tech giant said it will announce its stance on the issue after reviewing the case in detail.
The news about the alleged brand infringement comes days after Samsung quietly upgraded the sleep tracking feature of its Galaxy Watch devices.  With the latest update, which was released last week, the sleeping tracker of Galaxy Watch smartwatches no longer requires continuous heart rate monitoring to detect REM sleep.
The Galaxy Watch now automatically enables a “frequent” mode that measures REM sleep every ten minutes. This is an optional feature, so users can switch it off with a toggle in the settings. And even though the mode is not that accurate in tracking REM sleep, it reduces battery usage overnight so users can make use of their Galaxy Watch longer during the day.
